The mayor of Mount Vernon, New York, is claiming the resignation of Attorney General Eric Schneiderman negates the legal authority of the acting attorney general to pursue a felony case against him. Mike Gianaris and even former U.S. Attorney Preet Bharara.
The Legislature had previously announced 16 applicants to be questioned by the committee, which was down to 13 on Tuesday, following dropouts from David Yassky, the chairman of the Taxi and Limousine Commission who is also a former member of the New York City Council; former Assistant Secretary of State Jose W. Fernandez; and Hudson Valley Congressman Sean Patrick Maloney.
"I think all that will help me do this job", Underwood said.
"(If) the legislature fills the vacancy with Acting Attorney General Barbara Underwood, then I do not wish to be considered for the position", wrote Holtzman, D-Brooklyn. "There's some truth to that, but I can assure you that is not who I am".

"It's time to put people ahead of politics, and ultimately let the voters decide who their next attorney general will be", Flanagan said in a statement.
Underwood said she has no plans to run for attorney general in November, which she said makes her a better option for the position now during the interim period.
The beginning of candidate interviews for a new state attorney general was held on Tuesday by a legislative committee that included members from both parties.
