Appeals Court Refuses To Toss Planned Parenthood Video Lawsuit

It seeks an injunction that would put the law's July 1 implementation on hold during the lawsuit.

In Iowa, the state's attorney general is taking a stand against the recently signed the so-called "heartbeat ban" law, outlawing abortions after a fetal heartbeat is detected, which could be as early as six weeks into a pregnancy. Litigation could take years.

Two of the most restrictive state abortion laws in the country could go into effect soon.

"We've moved quickly to challenge this cruel and reckless law because it can not be allowed to take effect", Rita Bettis, legal director for the ACLU of Iowa, told a news conference.

Miller said the Thomas More Society, a conservative Chicago-based law firm, has agreed to defend the law for free.

The abortion-rights groups declined to make the legal documents public until the court clerk filed and stamped official copies.

Iowa Republican Gov. Kim Reynolds said she anticipated the lawsuits when she signed Senate file 359.

Iowa Attorney General Tom Miller, a Democrat, said he would refuse to represent his state in defense of the new law. "It's about protecting life". "In the 45 years since (Roe v. Wade), no federal or state court has upheld such a risky law".

Miller's decision to recuse himself was hailed by the non-profit reproductive health care organization Planned Parenthood, with executive vice president Dawn Laguens commending Miller "for standing up for a woman's right to control her own body, and decide for herself whether and when to become a parent".

It is one of many legal proceedings between Daleiden, the Center for Medical Progress and abortion activists with Planned Parenthood and the National Abortion Federation, both of which were exposed in some of CMP's already released videos.

The law is evidence of the state's conservative shift after the 2016 election, when Republicans gained control of the Legislature and the governor's office for the first time in almost 20 years.

"It's a way to wiggle away at Planned Parenthood federal funding, and a way to reinforce the idea that abortion is not family planning".

Following failed efforts to defund Planned Parenthood through congressional legislation, a group of about 80 pro-life organizations sent a letter to the Trump administration earlier this month requesting a return to the Reagan rule.
