49ers' Foster Won't Stand Trial On Domestic Violence Charges

Judge Nona Klippen ruled on Wednesday that there was insufficient evidence to proceed with the domestic violence case against San Francisco 49ers linebacker Reuben Foster.

Foster was arrested on February 11 when his then-girlfriend Elissa Ennis flagged down a stranger's vehicle to call 911 and told responding sheriff's deputies and Los Gatos police that the National Football League player had dragged her by her hair, threw her out of the house and punched her in the head eight to 10 times, leaving her bruised and with a ruptured eardrum.

Last week, Ennis, 28, testified for two hours, saying multiple times that Foster didn't hit her on that morning and that she concocted the first story she told police because she was furious that he was going to end their relationship.

Ennis testified on May 17 she fabricated the claims against Foster for personal gain.

A judge dropped domestic violence charges against 49ers linebacker Reuben Foster on Wednesday afternoon.

The judge reduced Foster's assault weapon charge from a felony to a misdemeanor and scheduled a pre-trial hearing for June 6, according to NFL Network's Patrick Claybon. Klippen said there was a "ring of truth" to her testimony that she was anxious about losing that lifestyle after Foster broke up with her, which would give her reason to try to get money from him.

Ennis also testified that after Foster's arrest, she went home to Louisiana with his jewelry and about $8,000 in cash. Niners teammates Adrian Colbert and Jaquiski Tartt attended the hearing in support of Foster.

In addressing her initial accusations against the 49ers star, Ennis said, "I didn't think it would get this far".

Neither Bentley nor Smith commented after Wednesday's proceedings.

The Santa Clara County District Attorney's Office issued its own statement saying it was disappointed in the ruling "because the evidence demonstrated that Mr". Foster seriously hurt his girlfriend. She said the injuries she sustained came in a fight she was involved in before the alleged incident with Foster.

"The organization is aware the domestic violence charges against Reuben Foster were dismissed earlier today. Whatever the cause, we move forward on cases when victims falsely recant because we know that if we don't more victims will be hurt".

Foster's attorney also asked Ennis whether she had planned to try to "ruin his career" when he broke up with her, to which Ennis responded affirmatively.

Foster played in 10 games in his rookie campaign last season for the 49ers, recording 59 tackles.
